Apply for a UK Visa as an Adult Requiring Care from a Relative

If you are an adult needing long-term care, you may be eligible to apply for a UK visa to be cared for by a relative permanently residing in the UK. This visa is applicable only if you are coming from outside the UK, or if you are extending your stay under this visa category.

Requirements for the Relative in the UK

The relative in the UK who will be caring for you must meet one of the following criteria:

They are a British or Irish citizen.

They have settled in the UK, evidenced by indefinite leave to remain, settled status, or proof of permanent residence.

They are from the EU, Switzerland, Norway, Iceland, or Liechtenstein with pre-settled status and began residing in the UK before January 1, 2021.

They have a form of protection status in the UK, such as refugee status or humanitarian protection.

What You Need to Prove

To apply, you must demonstrate:

You require long-term care due to illness, disability, or age, which inhibits your ability to perform daily personal and household tasks.

You are aged 18 or over.

The care you require is not accessible or affordable in your home country.

Financial and Accommodation Requirements

You must also prove that your relative in the UK can adequately accommodate and care for you without the need to access public funds. This includes proving that they can support you for:

The duration of their permitted stay in the UK, if they are not a British citizen or permanently settled.

A period of 5 years, if they are a British citizen or have settled status.

It is crucial to provide evidence of your relative’s income, factoring in their housing and any potential care costs.

FAQs

The duration of your stay in the UK under a family visa depends on the status of your
UK-based family member:

  • British, Irish, or Settled Family Member: If your family member is British, Irish, or has settled status in the UK, your stay is unlimited. There is no need to apply for an extension or settlement.
  • Family Member with Pre-Settled Status: If your family member has pre-settled status and started living in the UK before 1 January 2021, you can stay as long as your family member remains in the UK. You will need to apply to extend or settle concurrently with them.
  • Family Member with Protection Status: For family members who have protection status in the UK, including refugee status or humanitarian protection, you can remain in the UK as long as they do, with necessary applications for extensions or settlement when required.

The processing time for your visa application depends on where you apply from:

  • Applying from Outside the UK: Applications from outside the UK typically receive a decision within 24 weeks.
  • Applying from Inside the UK: Applications made from within the UK usually receive a decision within 8 weeks.
