Apply as a Partner or Spouse in the UK

Are you planning to join your partner or spouse in the UK? Applying as a partner or spouse comes with specific requirements and guidelines that both parties must fulfill.

Here's what you need to know:

Age Requirement

Both you and your partner must be 18 years or over to qualify for applying as a partner or spouse in the UK.

Partner’s Eligibility Criteria

Your partner must satisfy one of the following conditions:

Be a British or Irish citizen

Have settled in the UK, including having indefinite leave to remain, settled status, or proof of permanent residence

Be from the EU, Switzerland, Norway, Iceland, or Liechtenstein and have pre-settled status (must have started living in the UK before 1 January 2021)

Have a Turkish Businessperson visa or Turkish Worker visa

Have protection status, including leave to remain as a refugee, permission to stay as a refugee, or person with humanitarian protection

Intention to Live Together

You and your partner must have the intention to live together permanently in the UK after you apply. This commitment forms an essential part of the application process.

Benefits of Settled or Pre-Settled Status

If your partner has settled or pre-settled status, you may be eligible to apply to the free EU Settlement Scheme. This scheme provides additional rights and benefits for those joining their partners in the UK.

Applying as a partner or spouse in the UK is a significant step that requires a thorough understanding of the guidelines and eligibility criteria. By ensuring that both parties meet these requirements, you pave the way for a smooth application process and a fulfilling life together in the UK. FAQs

You must prove your relationship through marriage or civil partnership, living together for at least 2 years, or engagement with plans to marry within 6 months. Additional requirements include good English knowledge and financial ability to support yourself and dependants.

Exceptions include circumstances related to a child in the UK, significant difficulties living as a couple outside the UK, or situations where denying entry or asking you to leave would breach your human rights.

Evidence such as marriage certificates, utility bills, joint bank statements, or letters confirming a shared address can be used. The evidence must come from recognised sources like the government, banks, or landlords and be less than 4 years old.

Items like greeting cards, travel tickets, receipts, photographs, and text or social media messages are not usually considered strong evidence for your application; however, please seek advice as we would be able to consider your documents and confirm the merits of your case.

You can stay for 2 years and 9 months on this visa, or 6 months if applying as a fiancé, fiancée, or proposed civil partner.

Yes, you can add children as dependants if they are under 18 and do not live an independent life.

You can apply for ‘indefinite leave to remain’ after living in the UK for 5 years on a family visa as a partner. Specific rules apply for those who applied before 9 July 2012.
