On a Sale you should instruct a solicitor when you put your house on the market or when you have an offer accepted and as a buyer you can do this when you have an offer accepted.
The average time between instructing your solicitor and moving in is 10-12 weeks but many transactions proceed more quickly and some, more slowly.
If you are selling you need to budget for estate agent’s fees and legal fees. If you are buying you need to budget for legal fees and disbursements. “Disbursements” are payments made by your solicitor to others, such as stamp duty, land registry fees and search fees. Please see our costs section of the website to view further detail of these costs. Most buyers aim to save at least 10% of the total purchase price. Indeed, most lenders only tend to give 90% mortgages.
This is because all solicitors are required by law to check the identity of their clients to protect themselves against mortgage fraud or money laundering.
You can do this before you decide on the eventual Property you purchase.. There are thousands of different mortgages on the market and you need time to find out which one is best for you. You can obtain a mortgage in principle from most lenders before finding a particular property.
Once contracts are exchanged a legally binding agreement arises and neither party can back out. Until that point either party may withdraw.
You do not have to sell your home before you make an offer on a new one. However, some people may prefer to do so. Ultimately, it is up to you, and there are pros and cons to each option. For example, selling before you buy a new home will make you a more attractive buyer, but it may also mean you will need to rent a home while waiting for your new one to be ready.
Exchange of contracts is the written agreement date and the point at which the seller and buyer agree to commit themselves unconditionally to the transaction. A completion date is the date on which you move into your new property and vacate the old one.
Usually yes the deposit amount is 10% of the purchase price but your solicitor can agree less if this is required. This is a matter of negotiation.
Searches are an essential part of the Conveyancing process and are also required if you are obtaining a mortgage. The main searches we will carry out on your behalf are listed below but we can also run additional searches that may be necessary if further issues are flagged up:
Local search – These searches take a look into all of the local authority’s information about the property. This includes who is responsible for maintaining roads and paths bordering the property, planning permission, and restrictions.
Drainage and water search – does the property have mains water and drainage? The local water company will also provide other helpful information, such as the position of pipes.
Environmental search – this search will check environmental issues such as that your property is not, for example, built on an old landfill site, on or near contaminated water, or is at risk of subsidence.
Chancel repair liability search – check you will not be liable to pay for the maintenance of your local church.
If you are taking out a mortgage your lender will require a valuation but this is not a survey and is for the lender’s benefit, not yours. It is always sensible to have your own independent survey. Your solicitor can recommend a good local surveyor.
A contract usually provides for you to insure on exchange of contracts. Therefore its good to ensure you have this in place as soon as exchange has occurred.
Nowadays there are no “Deeds” as such as the legal documents of title are held electronically at the Land Registry. However there are a number of useful supporting documents which you should keep safe as they are required when the property is sold again.
You’ll get the keys to your new property on the day of completion. This is the point at which the money is transferred to the seller, and the property becomes yours. Your conveyancer will also deal with the transfer of funds, deeds, and other required documents on completion day.
